By accessing or using Go Call Panda's Go Call Panda Phone Agent service ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
Go Call Panda provides Go Call Panda Phone Agent and Go Call Panda SMS Agent services that automatically respond to incoming calls and SMS messages, qualify leads, answer questions, and book appointments on behalf of solar companies and other businesses.
Go Call Panda is a product by Driftwood Crew Consulting (ABN 24 360 179 425).
3. User Accounts and Registration
- You must provide accurate and complete information when registering for our Service
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized use of your account
- You are responsible for all activities that occur under your account
- You must be at least 18 years old to use our Service
4. Acceptable Use
You agree not to use our Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Engage in telemarketing that violates applicable laws
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service for any illegal or unauthorized purpose
5. Call Recording and Consent
Our Service may record phone calls. By using our Service, you:
- Consent to the recording of calls made to or from your Go Call Panda Phone Agent
- Agree to comply with all applicable laws regarding call recording and consent
- Acknowledge that it is your responsibility to inform callers that calls may be recorded where required by law
- Accept that recordings may be used to train and improve our Go Call Panda Agents
6. Payment Terms
- Fees are charged based on your selected pricing plan
- All fees are in Australian Dollars (AUD) unless otherwise stated
- Fees are billed in advance on a monthly or annual basis
- You are responsible for all applicable taxes
- We reserve the right to change our fees with 30 days notice
- Refunds are provided at our discretion and in accordance with our refund policy
7. Service Availability
While we strive to provide uninterrupted service, we do not guarantee that the Service will be available at all times. We may suspend or terminate the Service for maintenance, updates, or other reasons without prior notice.
8. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by Go Call Panda and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your data as described in our Privacy Policy. You retain ownership of your customer data, but grant us the right to process it to provide the Service.
10. Third-Party Integrations
Our Service may integrate with third-party platforms such as CRMs, calendars, and communication tools. We are not responsible for the functionality, availability, or policies of third-party services. Your use of third-party services is subject to their respective terms and conditions.
11. Limitation of Liability
To the maximum extent permitted by law, Go Call Panda shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
